The mission of the ACLU of Delaware is to preserve and advance civil liberties and civil rights in the State of Delaware as enshrined in the United States and Delaware Constitutions through education and advocacy without consideration of political association.

ATTENTION CIVIL RIGHTS WATCHDOGS: 


It’s safe to say 2025 was a hard year for our community and our country. But it is through our community, our strength, and our resilience that we are able to grow together.  

Whether you’ve attended a Know Your Rights training, a Bird-Dog training, a Lobby Day, a canvassing event or took action by sending messages to your elected officials, you were part of a movement to protect civil rights in Delaware. Those are just some of the ways our community came together to fight back against fascism last year.  

Will you join us to defend civil liberties and protect civil rights in Delaware?

We continue to see bills, actions, and decisions that are blatant attempts to control who has access to the ballot and who does not, who has bodily autonomy and who does not, who deserves to learn in an amply resourced and safe school environment, and much, much more. In order to create the change we demand to see, we need to elect equal rights champions to office, bring our communities into conversations about legislation that affects us, and reduce barriers to representation, resources, and the rights we are all entitled to in the US Constitution. 

Here are just a few of the changes we'll be focusing on over the next year: 


Voting Rights
The right to vote, and to have one’s vote accurately and fairly counted, is a fundamental right of all American citizens that underpins the rest of our civil liberties. That’s why we must ensure our election system is accessible and equitable. To achieve this, we must:
  •  Restore voting rights after felony incarceration and allow individuals to fully reintegrate into society.
  • Protect and expand early in-person voting and no-excuse absentee voting to increase access and participation, particularly for working families, older adults, and people with disabilities.
  •  Implement same-day voter registration to streamline the voting process and ease the burden on voters to ensure no one is left out of the democratic process. 
  • Enact a State Voting Rights Act to prohibit discriminatory voting policies and practices and expand access for voters with disabilities and limited English proficiency.
 
 Immigrants’ Rights
The fundamental constitutional protections of due process and equal protection apply to every person, regardless of immigration status. In order to protect our immigrant communities, Delaware must take the following steps: 
  •  Prohibit the arrest of people at sensitive places such as schools, medical facilities, places of worship and courthouses, without a valid judicial warrant or court order to protect immigrant families. 
  •  Make illegal racial profiling of people based on suspected or actual immigration status. 
  •  Create safe interactions with law enforcement by requiring law enforcement officers to show their face and identify themselves. 

Privacy
The rapid expansion of digital surveillance and the collection of sensitive personal information poses a serious threat to individual privacy and civil liberties. In Delaware, we must take action to ensure sensitive personal information cannot be weaponized against vulnerable communities by banning reverse warrants that enable unconstitutional government surveillance of anyone in a certain location during a certain time or who sought certain information through online searches.

Justice Reform
Delaware continues to have one of the highest incarceration rates in the northeast corridor—and reincarceration for minor technical violations continues to drive that rate up. It’s time for Delaware to build a probation system that prioritizes helping people rebuild their lives  by restricting the use of incarceration for rule violations.
